This website, talktosomeone.ca (the "Site"), is owned and operated by Talk to Someone Inc. ("we," "us," "our"), a business operating under the laws of Ontario, Canada. "You" or "your" means any visitor to the Site.
Please read these Terms of Use carefully before using the Site or any related services ("Services"). By accessing or continuing to use the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
Use of the Site
By using the Site, you confirm you are the age of majority in your jurisdiction and able to enter into a legally binding agreement. We aim to keep the Site accurate and current but do not guarantee that all content is complete, accurate, or up to date at all times. We may modify, suspend, or discontinue any part of the Site or Services at any time without notice, and we are not liable for any such change.

Not a Crisis Service
This Site is not monitored in real time and is not intended for emergencies. If you are in crisis or experiencing a mental health emergency, call 911, go to your nearest emergency room, or contact a crisis line such as the Ontario-wide ConnexOntario line (1-866-531-2600) or, across Canada, 988 (Suicide Crisis Helpline).
No Therapist-Client Relationship Formed by Site Use
Visiting or submitting a form on this Site does not create a therapist-client relationship. No professional duty, including any duty of confidentiality, is owed to you as a result of browsing the Site or submitting an inquiry. A therapist-client relationship, and the professional obligations that come with it, begins only once a formal intake process is completed and a therapist has expressly agreed to provide services to you.
Nothing on this Site is medical, psychological, legal, or financial advice, and it should not be treated as a substitute for individualized professional care. Content on the Site (including blog posts, descriptions of approaches, or FAQs) reflects general information only.
Fees
Session fees are as communicated to you directly by your therapist or as listed on the Site, in Canadian dollars, and may change without notice. Refund and cancellation terms (e.g., late-cancellation or no-show policies) will be provided to you as part of your intake or client agreement, separate from these Terms.
Intellectual Property
All content on the Site, including text, images, graphics, logos, and design, is owned by us or used under license, unless otherwise credited. You may not copy, reproduce, republish, or use this content for commercial purposes without our prior written consent. You may view and share pages of the Site for personal, non-commercial purposes (e.g., sending a link to a friend).
Third-Party Tools and Applications
We use third-party services to operate the Site and deliver care, which may include booking and practice-management software (such as Jane App), payment processors, email tools, and advertising or analytics tools (such as Google and Meta). Your use of these tools is also subject to their own terms and privacy practices, which we encourage you to review. We are not responsible for the practices or failures of third-party services.
Your Communications With Us
Information submitted through our contact or intake forms is used to respond to your inquiry and, where applicable, begin the intake process. These communications are not to be treated as confidential or privileged in a legal sense (a formal duty of confidentiality applies only once a therapist-client relationship is established, per your client agreement and applicable professional standards, such as those of the OCSWSSW or CRPO).
Please do not submit sensitive clinical details, crisis information, or anything you would not want transmitted over standard email or web forms through this Site.
Assumption of Risk and Disclaimers
Use of the Site is at your own risk. The Site and its content are provided "as is," without warranties of any kind, express or implied, including warranties of accuracy, availability, or fitness for a particular purpose, to the fullest extent permitted by law.
We do not guarantee any particular outcome from therapy or from use of the Site. Testimonials or examples referenced on the Site reflect individual experiences and are not a promise of similar results for you.
We are not liable for technical failures, interruptions, or security breaches beyond our reasonable control, though we take reasonable steps to protect information submitted through the Site.
Limitation of Liability
To the fullest extent permitted by law, we and our therapists, staff, officers, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site, including but not limited to loss of data, loss of income, or emotional distress arising from Site use (as distinct from clinical services, which are governed separately by your client agreement).
Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or costs (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.
Termination
We may restrict or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or used the Site in a way that is harmful, unlawful, or disruptive.
Governing Law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. Any disputes will be resolved in the courts of Ontario.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted means you accept the revised Terms. Please check this page periodically.
